These Terms govern access to and use of the Cadence platform.
By using Cadence, you agree to these Terms. Please read them carefully, and contact us if you have a question about how they apply to your program.
Acceptance of Terms
By creating an account, accessing, or using the Cadence platform (the “Platform”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, you must immediately discontinue use of the Platform. These Terms constitute a legally binding agreement between you and Future Force LLC (“Future Force,” “we,” “us,” or “our”).
Your continued use of the Platform following any changes to these Terms constitutes your acceptance of those changes. We reserve the right to modify these Terms at any time, and those modifications become effective when posted to the Platform.
Platform Purpose and Services
Cadence is a digital platform for cadets, students, alumni, instructors, and administrators to manage, track, and showcase educational artifacts, assignments, achievements, certifications, readiness indicators, career pathway data, and related information in a secure, compliance-aligned environment.
The Platform supports JROTC programs and similar educational initiatives with tools for portfolio management, progress tracking, communication, and career development planning.
User Accounts and Eligibility
Account registration
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information; maintain and promptly update that information; protect the security and confidentiality of your credentials; accept responsibility for activity under your account; and immediately notify us of unauthorized access or a security breach.
Authorized users
The Platform is available to authorized cadets, students, alumni, instructors, educational leadership, program administrators, and other approved personnel. Access is granted based on your role and affiliation with participating institutions or programs.
Prohibited activities
You may not use unauthorized automated systems to access the Platform; probe, scan, or test its vulnerabilities; circumvent access controls; impersonate others or misrepresent your affiliation; share credentials with unauthorized individuals; or use the Platform for an unlawful purpose or in violation of applicable law.
Data Privacy and Protection
Your privacy is important to us. Our collection, use, storage, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the data practices described in that policy.
We implement security measures aligned with applicable federal and state requirements, including FERPA, the Privacy Act of 1974, the Department of Defense Privacy Program, applicable Department of Defense security requirements and DFARS provisions, and NIST Special Publication 800-171 controls.
We apply least-privilege access controls, encryption in transit and at rest, audit logging, and continuous monitoring to protect information.
Acceptable Use Policy
You must use the Platform responsibly and lawfully. You may not upload malicious code; harass, threaten, or abuse other users; post unlawful, defamatory, obscene, or infringing content; seek unauthorized access to accounts, data, or systems; export controlled or sensitive data unless specifically authorized; impair our servers or networks; interfere with another user’s access; or collect personally identifiable information without authorization.
Violation of this policy may result in immediate suspension or termination of your account and may be reported to appropriate authorities.
Support Requests and Escalation
Cadets and students
Cadets and students may not contact the Cadence support desk directly, whether by email, telephone, the contact form, or any other support channel. Support for cadets and students is delivered through their instructor, who is the first point of contact for questions about accounts, access, assignments, grades, uploaded work, and Platform functionality.
Instructors
Instructors are responsible for receiving requests from their cadets and, where a request cannot be resolved at the program level, submitting it to the support desk on the cadet’s behalf. Before submitting, an instructor should confirm that the cadet is signed in to the correct account, is enrolled in the expected class period, and is viewing the assignment or lesson in question, and should be able to describe what was already attempted locally.
A request submitted from a signed-in account is attributed to that account. Changing the reply address on a request changes only where our answer is sent, not who we are told asked, and the instructor who submits remains responsible for the request under Section 03, including the accuracy of what is reported and the appropriateness of what is included in it.
How to reach the support desk
Signed-in instructors and other approved educators should use the Submit an issue form in the Platform’s help center. It is the fastest route, because your account, institution, and role travel with the request and the desk does not have to establish who you are before it can begin. Email support@cadencepathway.com and telephone 1 (866) 405-5995 reach the same desk and are the right channel when you cannot sign in. People who do not hold a Cadence account, including prospective programs, should use the contact form.
Support is provided through those channels only. A request made to an individual member of Future Force staff by direct message, personal email, social media, or conversation at an event is not tracked and may not be worked at all. A request is not received until it has been filed through one of the channels named in this section.
Support desk hours
The support desk is staffed from 8:00 AM to 5:00 PM Eastern Time, Monday through Friday. It is closed outside those hours, on weekends, and on holidays we observe. A request submitted while the desk is closed is queued and picked up on the next business day; the Platform itself remains available at all times, subject to Section 09. Our hours may change, and the hours published on the help center and Contact pages are the current ones.
The support desk is not monitored for emergencies. If there is a risk to anyone’s safety, contact local emergency services and follow your institution’s own procedures rather than contacting the desk.
What to include in a request
State what kind of problem it is, what you were doing, what you expected, and what happened instead. If the Platform displayed an error reference, include it; that reference is how a specific failure is located in our logs. Files and screenshots cannot be attached to the help center form, and the desk will ask for them by email where they are needed.
Identify an affected cadet using the identifiers the Platform already shows you, such as the name on your roster and the class period, and nothing further. Never send passwords, one-time codes, session cookies, or other credentials to the support desk. No one at Future Force will ask you for them, and a request containing a credential may be discarded and the credential treated as compromised. Do not include education records, health information, or other personal information beyond what the request genuinely requires. Section 04 and our Privacy Policy govern our handling of information you send us.
What to expect after you submit
When the desk accepts a request, the Platform displays a ticket reference. Keep it, because it identifies the request in any later correspondence. There is no automatic acknowledgement email; the first email you receive about a request is a reply from a person, sent to the reply-to address on that request. If the Platform tells you the request could not be sent, it was not filed, and you should try again or contact the desk by email.
Requests are worked in the order received, except that we may take ahead of the queue anything that blocks an entire program, risks the loss of student work, or concerns the security of data. We may ask for further information before a request can progress, and we may close a request that has been awaiting your answer for an extended period. A closed request may be reopened by replying to it.
These Terms do not establish a guaranteed response or resolution time. The hours stated above describe when the desk is staffed; they are not a service level. Where your institution’s written agreement with Future Force sets service levels, that agreement governs and controls over this section. Nothing in this section modifies Section 09, Section 12, or Section 13.
What the support desk can and cannot do
The desk can investigate defects, correct Platform data it is authorized to correct, restore access, and explain how a feature is intended to work. It cannot make academic decisions on your institution’s behalf. Grades, assessment outcomes, discipline, enrollment eligibility, and program requirements belong to the institution and its instructors, and requests concerning them will be referred back to your program. The desk does not support your institution’s own devices, accounts, or network.
Reasonable use of support channels
Support channels are rate limited per account and are intended for genuine requests from the people described in this section. You may not submit requests by automated means, submit the same request repeatedly, or use a support channel to send bulk or unsolicited messages. Duplicate submissions delay triage for every program, including your own.
Requests received directly from cadets
If a cadet or student contacts the support desk directly, we will not act on the request. We will direct the cadet to raise the issue with their instructor, who may then bring it to the support desk. This does not limit our ability to respond where a response is required by law.
Exceptions
This section governs routine support and does not restrict a cadet or student from reporting a security vulnerability under Section 08, reporting an accessibility barrier through the channels listed on our Accessibility page, requesting termination of an account under Section 11, exercising a right described in our Privacy Policy, or seeking informal resolution of a dispute under Section 16.
Intellectual Property Rights
Platform ownership
The Platform, including its software, interface, design, workflows, proprietary logic, trademarks, logos, and related intellectual property, is owned by Future Force LLC and protected by United States and international intellectual property laws.
User content
You retain ownership of content, materials, and information that you upload, submit, or post to the Platform (“User Content”). You grant Future Force a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute User Content solely to operate, maintain, and improve the Platform and provide services to you. You represent that you have the necessary rights to that content and that it does not violate third-party rights or applicable law.
Restrictions
You may not copy, modify, distribute, sell, or lease any part of the Platform; reverse engineer, decompile, or attempt to extract source code; remove proprietary notices; or use the Platform to develop competing products or services.
Security and Vulnerability Disclosure
Security is a priority. We maintain robust safeguards and conduct regular security assessments to protect user data and system integrity.
Prohibited security testing. You may not conduct penetration testing, vulnerability scanning, security testing, or other security assessments without Future Force’s prior written authorization.
Responsible disclosure. If you discover a vulnerability, report it promptly by emailing support@cadencepathway.com or calling 1 (866) 405-5995. We appreciate responsible disclosure and will address legitimate security concerns.
Service Availability and Modifications
We strive to maintain continuous availability but do not guarantee uninterrupted access. The Platform may be temporarily unavailable because of maintenance, updates, technical difficulties, or circumstances beyond our control.
We may modify, suspend, or discontinue Platform features; impose usage limits; update requirements or specifications; and apply critical security updates without advance notice when necessary for compliance, security, or stability. We will make reasonable efforts to provide advance notice of material changes, except where immediate action is required.
Payment Terms and Access Tiers
Platform access is arranged through institutional agreements, contract vehicles, or purchase orders. Access tiers, features, and pricing are determined by the written agreement with Future Force. Cadence does not offer online checkout or self-service subscription management; accounts are provisioned manually after an agreement is in place.
If you are responsible for payment, you agree to pay applicable fees according to your agreement. Fees are invoiced under that agreement and are non-refundable unless expressly stated in it or required by law. Failure to pay may result in suspension or termination, late fees, and collection efforts. Renewal terms, including any automatic renewal, are governed solely by your written agreement rather than by the Platform.
Termination of Access
We may suspend or terminate your account and Platform access, with or without notice, for violation of these Terms or the Acceptable Use Policy; fraudulent, abusive, or illegal activity; a security risk; a legal or regulatory requirement; non-payment; prolonged inactivity under our retention policy; or termination of your institution’s agreement with Future Force.
Upon termination, your right to access and use the Platform ceases immediately. We may retain information as required by law or for legitimate business purposes, as described in our Privacy Policy. You may terminate your account by emailing support@cadencepathway.com or calling 1 (866) 405-5995; termination does not relieve prior obligations.
Disclaimers and Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. To the maximum extent permitted by law, Future Force disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, completeness, uninterrupted operation, security, error-free operation, and correction of defects.
We do not warrant that the Platform will meet your requirements or operate uninterrupted or error-free. You assume responsibility for your use. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUTURE FORCE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including lost profits, revenue, data, use, goodwill, business interruption, or costs of substitute services.
OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE FEES PAID BY YOU, OR BY YOUR INSTITUTION ON YOUR BEHALF, TO FUTURE FORCE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. These limits apply regardless of legal theory. Some jurisdictions do not allow certain limitations, so they may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless Future Force, its officers, directors, employees, agents, affiliates, and partners from claims, liabilities, damages, losses, costs, expenses, and reasonable attorneys’ fees arising from your use or misuse of the Platform; violation of these Terms, law, or third-party rights; User Content; or negligence or willful misconduct. We may assume exclusive defense and control of any matter subject to indemnification, and you will cooperate with available defenses.
Changes to Terms
We may modify or update these Terms at any time. When material changes are made, we may post updated Terms with a revised “Last updated” date, send notice to the email associated with your account when practicable, or display a prominent Platform notice. Continued use after the effective date constitutes acceptance. If you do not agree, discontinue use. Please review these Terms periodically.
Governing Law and Dispute Resolution
These Terms and your use of the Platform are governed by the laws of the State of Georgia and applicable United States federal law, without regard to conflict-of-law principles. When provided under a federal contract, applicable federal regulations and contract provisions may supersede state law.
Any legal action relating to these Terms or the Platform must be brought exclusively in federal or state courts located in Georgia, and you consent to their personal jurisdiction. Before filing formal legal action, you agree to first attempt informal resolution by emailing support@cadencepathway.com or calling 1 (866) 405-5995.
Miscellaneous Provisions
These Terms, the Privacy Policy, and other legal notices or agreements published on the Platform form the entire agreement regarding your use of Cadence and supersede prior understandings. If a provision is found invalid or unenforceable, the remaining provisions remain effective.
Our failure to enforce a provision is not a waiver. Any waiver must be in writing and signed by an authorized Future Force representative. You may not assign or transfer these Terms or your account without our written consent; we may assign these Terms or delegate obligations without consent. We are not liable for failure or delay caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or government action.
